As a registered Member of the CareZone Services, as contemplated by the CareZone Terms of Service, you may request additional CareZone Services that Care Zone Inc. (“CareZone” or “we”) may elect to make available from time to time. We are pleased to provide you an opportunity to register for our Pharmacy Assistance CareZone Service as further described below (“Pharmacy Assistance”), which Pharmacy Assistance is subject to these Additional Terms of Service. These Additional Terms of Service are expressly made a part of and incorporated into the CareZone Terms of Service. In the event of any conflict between the CareZone Terms of Service and these Pharmacy Assistance Additional Terms of Service, these Additional Terms of Service apply solely to the extent applicable to the Pharmacy Assistance.
MODIFICATIONS
CareZone reserves the right, at its sole discretion, to modify, discontinue or terminate the Pharmacy Assistance CareZone Services or to modify these Additional Terms of Service, at any time and without prior notice. If we modify these Additional Terms of Service, we will post the modified Additional Terms of Service and alert you to the modifications on the Site or otherwise provide you with notice of the modifications. We will also update the “Last Updated Date” at the top of these Additional Terms of Service. By continuing to access or use the Pharmacy Assistance CareZone Services after we have posted a modification on the Site or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Additional Terms of Service. If the modifications are not acceptable to you, your only recourse is to cease using the Pharmacy Assistance.
WHAT IS PHARMACY ASSISTANCE?
Our Pharmacy Assistance CareZone Service allows us to facilitate the refills and the personal delivery to you of certain of your prescription drugs as a Member of the CareZone Services. In order to use the Pharmacy Assistance CareZone Service, you must have a valid and lawful prescription from your healthcare provider or an existing prescription on file at a third party retail or mail order pharmacy.
We are not a pharmacy and as such cannot engage in pharmacy practices. Our Pharmacy Assistance is a personal service that we provide Members, similar to a personal concierge service. We can facilitate refill requests to certain of your prescriptions as they come due and arrange for your prescriptions to be picked up and delivered to you as further described below in these Additional Terms of Service.
We maintain relationships with a network of pharmacies from across the US. As a result, we can arrange for your prescriptions to be shipped to you using a third party delivery service via FedEx or comparable carriers.
CAREZONE AS YOUR AGENT
In order for us to provide you Pharmacy Assistance, you will need to designate us as your personal agent, expressly authorized to perform the following tasks on your behalf:
- Select a pharmacy able to meet our network requirements
- Communicate with the pharmacy on your behalf
- Arrange for pickup and delivery of your prescription from the pharmacy location to your home or designated delivery address through the use of a third party delivery or shipping company.
By electing to engage CareZone for the Pharmacy Assistance CareZone Service, you are expressly appointing CareZone as your agent for these purposes.
ADDITIONAL PERSONAL INFORMATION
In order to communicate with the pharmacy on your behalf, you will need to provide us with a copy of your insurance card. You can upload the image of your insurance card via your mobile device for storage within your Profile Content, as contemplated by the Terms of Service. We will also need you to provide your credit card information for any payments to the pharmacy for your prescription. This information will be collected and maintained as part of your Profile Content and will be subject to our Privacy Policy.
CareZone is not responsible for any errors in the information that you submit to CareZone in registering or requesting Pharmacy Assistance, including without limitation any errors in your insurance card or credit card information as you provide it to us. You will be solely responsible for any additional fees or misdeliveries that may result from errors in your information.
NETWORK ELIGIBILITY
The pharmacy that we currently use in connection with the Pharmacy Assistance may be an out-of-network provider for your prescription. As a result, prescriptions that you obtain through CareZone may be at a higher cost than those you receive from your in-network provider. We encourage you to confirm the scope of your prescription drug benefit as prescriptions obtained through CareZone may be at full price to you.
PRESCRIPTION LIMITATIONS
Pharmacy Assistance is not available for all prescriptions. CareZone cannot arrange delivery of dangerous prescriptions, such as biohazards or radioactive substances, or prescriptions that are not allowed to be shipped or delivered to you due to rules of the shipping company or state or federal rules and regulations. In the case your prescription consists of any prohibited items, you assume all responsibility and liability for such prescription and any damages or losses that result from your failure to adhere to these Pharmacy Assistance restrictions. You will indemnify and hold harmless CareZone for any damages or liability related to any of your prescriptions.
PHARMACY COMMUNICATIONS
Upon receiving and processing your request to receive Pharmacy Assistance, we will notify the pharmacy of the prescriptions that you wish to transfer to the pharmacy on your behalf as your designated agent. The pharmacy may also need to contact you directly with any questions or concerns about your prescriptions. We will provide the pharmacy with your name, email, phone number, and insurance card information from the applicable Profile and Member Account to the pharmacy. We will also pass your credit card information directly to the pharmacy for the pharmacy to maintain for the purpose of charging any amounts due for your prescription. We do not maintain your credit card information in your Profile or Account information.
If you have any new prescriptions that need to be filled, you may have your medical professional send them directly to the pharmacy.
Our Pharmacy Assistance CareZone Services can also facilitate the delivery and receipt of messages to and from the pharmacy on your behalf. We strive to ensure the privacy and integrity of your communications, however, we do not provide a secure messaging system and, as with any online or mobile system, which is subject to outages, communication and data flow failures, interruptions and delays inherent in Internet communications, we cannot ensure the privacy or integrity of any messages. You recognize that problems with the Internet, including equipment, software and network failures, impairments or congestion or the configuration of your computer systems, may prevent, interrupt or delay your access to any communications within the CareZone Services. There is no warranty or guarantee that access or use of any communications features in CareZone will be uninterrupted or error-free. You should only use any communications feature of the CareZone Services for non-urgent communications, otherwise, please contact your pharmacy directly.
DELIVERIES
Deliveries are subject to the schedule and holidays of the third party shipping or delivery service. CareZone does not have liability for the acts or omissions of these third party services. CareZone is only an intermediary for the receipt and forwarding of your prescription by the third party delivery company.
If your Prescription is returned undeliverable or if there is an error in your address or other similar error that makes your Prescription undeliverable, CareZone has no liability for such an error. However, in the event of damage during shipping, CareZone will use its reasonable efforts to assist with any claim against the delivery carrier. CareZone’s maximum liability for loss, damage, expense or cost incurred are expressly limited by the terms listed within this Agreement and are limited only to the limited period during which Prescriptions are in the custody of CareZone. For all prescriptions, the delivery company’s policy will apply to any lost or damaged deliveries. CareZone shall have no liability if any claim is denied or only partially paid by the delivery carrier.
Upon pickup of your prescription by the third party delivery company, we will notify you through the CareZone Services that your prescription is on its way and the delivery service responsible for delivering it to you so that you review the delivery company’s policies. Shipping damages or lost Prescriptions should be reported directly to FedEx or other shipping carrier.
CareZone may introduce you to third party delivery services for the purposes of providing the delivery services. We will not assess the suitability, legality or ability of any delivery service and you expressly waive and release CareZone from any and all liability, claims, or damages arising from or in any way related to the third party delivery carrier. CareZone will not be a party to disputes, negotiations of disputes between you and such third party delivery carriers.
The quality of the shipping services scheduled through CareZone is entirely the responsibility of the third party shipping carrier providing the services to you. You understand and agree that your Prescription may be exposed to unsafe or otherwise objectionable situations and that you use the delivery services at your own risk.
REQUESTS FOR REFILLS
Within the Pharmacy Assistance CareZone Service, you can indicate whether you would like for us to request monthly refills of your prescription on your behalf. We will not request a refill of your prescription without your request to do so. By requesting us to automatically request monthly refills of your prescriptions, you are agreeing to pay the costs of your prescription on a monthly basis. CareZone has no responsibility for any payments by you to the pharmacy for the refill of your prescription.
UPDATES TO YOUR PROFILE CONTENT
If you would like to keep your CareZone profile up to date, you may request that the pharmacy release information about your prescription back to us at CareZone for us to automatically upload back into your applicable Profile. You may opt-in during your registration for Pharmacy Services to allow us to request your protected health information from the pharmacy in order to update the applicable CareZone Profile. If you authorize that release of information back to us, we will upload that information into the applicable Profile Content. We at CareZone are not responsible or liable in any way for the content or the accuracy of the information provided to us by the pharmacy. As set forth in the Terms of Service, it is your responsibility as the Member to confirm the accuracy of your Profile Content.
In addition, while we may receive your patient information from the pharmacy on your behalf, we are not subject to the Health Insurance Portability and Accountability Act (HIPAA). However, we take both the protection of your private health information and your ability to control and access such information very seriously, and will only use and disclose your information in accordance with our Privacy Policy.
ENTIRE AGREEMENT
These Additional Terms of Service, together with the CareZone Terms of Service and Privacy Policy, constitute the entire and exclusive understanding and agreement between CareZone and you with respect to the Pharmacy Assistance CareZone Services. The full CareZone Terms of Service are expressly made a part of these Additional Terms of Service as though fully set forth herein.
